True Strength & Fitness

Trading Name:
True Strength & Fitness

These terms relate specifically to the 12-month contract membership. Please retain a copy for your records.

1. Definitions and Interpretation

In these Terms and Conditions, the following expressions have the following meanings:

  • “Agreement” means the contract between True Strength & Fitness and the Member incorporating these Terms & Conditions, the Sign-Up Form, and Club Rules.
  • “Club” means True Strength & Fitness premises and facilities.
  • “Initial Minimum Term” means the mandatory 12-month commitment period starting from the Membership Start Date.
  • “Member” / “You” means the individual named on the membership application.
  • “Monthly Fee” means the recurring monthly payment due for membership.
  • “Payment Method” means the continuous payment authority set up via Direct Debit, credit/debit card (recurring Stripe payment), or Bacs.
  • “We” / “Us” / “Our” means True Strength & Fitness.

2. Formation of Contract & Minimum Commitment

2.1 Binding Agreement: By completing the online registration, checking the Terms & Conditions acceptance box on Stripe/App Checkout, and paying your initial fee, you enter into a legally binding contract with True Strength & Fitness.

2.2 12-Month Minimum Commitment: You expressly agree to remain a paying Member for a minimum period of 12 consecutive calendar months (“Initial Minimum Term”).

2.3 Rolling Basis After 12 Months: Upon completion of the Initial Minimum Term, this Agreement will automatically continue on a month-to-month rolling basis at the standard rate until formally cancelled in accordance with Section 5.

3. Fees, Payment & Access Suspension

3.1 Monthly Payments: Monthly fees are collected in advance on your designated billing date via your chosen recurring Payment Method.

3.2 Cancelling Payment Method vs. Contract: Cancelling your Direct Debit, debit/credit card, or instruction with your bank does not cancel your membership or legal obligation under this contract.

3.3 Failed Payments & Gate Access Revocation: If a monthly payment fails or is defaulted, your digital access pass / QR code on the True Strength & Fitness mobile app will be suspended, blocking physical entry to the facility. Restoring access requires settling all outstanding balances and updating valid payment details.

3.4 Administration & Failed Payment Fees: We reserve the right to charge a reasonable administrative fee (up to £15 per failed transaction) to cover bank and processor charges incurred due to bounced payments.

4. Cancellation During the 12-Month Initial Minimum Term

You cannot cancel your membership during the Initial Minimum Term for general preference (e.g. lack of use or change of mind). In accordance with UK Competition and Markets Authority (CMA) guidelines, early cancellation without liability for the remaining balance is permitted only under the following verified circumstances:

  • Medical Condition / Severe Injury: An unexpected, long-term medical condition or injury preventing gym exercise for 3 consecutive months or more. Requires written confirmation from a registered General Practitioner (GP) or hospital consultant.
  • Redundancy or Severe Financial Hardship: Formal notice of redundancy or loss of primary employment. Requires an official letter of redundancy from your employer or proof of Universal Credit qualification.
  • Permanent Relocation: Permanent relocation to an address more than 15 miles away from True Strength & Fitness. Requires official proof of new residence (e.g. utility bill, council tax statement, or signed tenancy agreement dated within the last 60 days).

Notice Period for Approved Early Cancellation: Approved early cancellations require 30 days’ written notice sent to support@truestrengthandfitness.co.uk. Payments due within this 30-day notice period remain payable.

5. Cancellation After the Initial Minimum Term

Once your Initial Minimum Term (12 months) has elapsed, you may cancel your membership at any time by giving 30 full days’ written notice via email to support@truestrengthandfitness.co.uk or through your member account portal.

6. Default, Non-Payment & Debt Recovery

6.1 Breach of Contract: If you cancel your Direct Debit or card authority before the end of the Initial Minimum Term without an approved exception under Section 4, or if you fall into arrears, you will be in material breach of contract.

6.2 Acceleration of Remaining Balance: Upon material breach or continued non-payment exceeding 14 days, the entire remaining balance of your 12-month contract becomes immediately due and payable.

6.3 Debt Collection Agency Referral: Unpaid accounts exceeding 30 days will be referred to an external UK debt collection agency. You agree to indemnify True Strength & Fitness for all costs incurred in recovering outstanding sums, including collection agency commission fees, administrative expenses, and legal costs.

6.4 Legal Action: Continued non-payment following referral may result in legal proceedings issued through the Small Claims Court, which may result in a County Court Judgment (CCJ) affecting your credit rating.

7. Club Rules & Digital Access Permission

7.1 App QR Code Access: Access to True Strength & Fitness is strictly granted via the official True Strength app. Your digital QR code is personal to you and non-transferable.

7.2 Fraudulent Entry: Allowing non-members or other individuals to enter the premises using your app account or QR pass is strictly forbidden and will result in immediate termination of membership. In such cases, the full remaining balance of the 12-month contract remains immediately payable.

7.3 Behaviour: Members must adhere to all posted Club Rules and show respect to staff and other members. Threatening, abusive, or unsafe behaviour will result in immediate expulsion and contract termination.

8. Limitation of Liability

8.1 Personal Property: True Strength & Fitness does not accept liability for loss or damage to member personal property while on the premises, except where caused by our negligence.

8.2 Statutory Rights: Nothing in this Agreement limits or excludes our liability for death or personal injury resulting from our negligence or statutory breach under the Consumer Rights Act 2015.

8.3 Health Responsibility: Members are responsible for ensuring they are physically fit and capable of engaging in exercise.

9. Data Protection & Governing Law

9.1 Privacy Policy: Personal data is processed in accordance with UK GDPR and our Privacy Policy available on our website.

9.2 Governing Law: This Agreement is governed by and construed in accordance with the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales.
